North Carolina Divorce and Family Law Lawyer
At our family law firm, we handle a wide variety of domestic relations cases that include:
- Absolute Divorce : North Carolina is a no fault state.
- Property Division : This is not a community property state. Though the judges do abide by equitable distribution principles, that does not mean all debts and assets will automatically be divided in half. North Carolina judges can only divide assets and debts that accumulate from the date of marriage to the date of separation.
- Spousal Support : North Carolina allows for two types of spousal support: temporary spousal support (called post separation support) and permanent alimony. Post separation support allows for the basic needs of the spouses to be met while going through the divorce process pending the permanent alimony trial. Permanent alimony takes into account many other factors throughout the marriage, to include but not limited to the lifestyle of the parties throughout the marriage up to the date of separation. There is no guarantee that a spouse will receive temporary or permanent spousal support.
- Child Custody and Support : North Carolina judges believe that most children benefit from regular, positive involvement with both parents. A custody agreement will account for daily living arrangements in addition to holidays and summers. Child support amounts are calculated based on the North Carolina Child Support Guidelines.
- International Family Law : We have extensive experience with international family law matters, including international child abduction, international child custody, and international child support. In addition, we regularly represent members of the military stationed around the world.
- Modifications : When circumstances significantly change after the initial filing of court orders, orders may need to be modified to address those circumstances. This most often happens with child custody and child support orders. We represent mothers and fathers seeking modifications and those opposing modifications.
We also handle annulments, adoptions, termination of parental rights, enforcement actions, and assist clients in obtaining attorneys in foreign countries.
